Fillon Affair : QPC before French Constitutional Council
As part of Fillon Affair, the French Constitutional Council examines a “priority question of constitutionality” (QPC) whose hearing was held on Tuesday September 19, 2023.
This QPC questions the conformity with the Constitution of Code de procedure pénale’s 385th article, relating to the mechanism for purging nullities, which would not guarantee an effective legal remedy right and would undermine exercise of defense rights.
Deliberation will be delivered on Thursday September 28, 2023.
